Trusts and Estates
When loved ones pass away we provide Probate or Trust Administration assistance professionally and expeditiously. When “bad actors” intervene we litigate to assert your interests and protect your inheritance rights.
Whether you are seeking to form a business entity; require expert counsel or litigation; or a simple bridge to your estate plans, we can counsel you in a range of strategies.
(Names are Fictitious)
Expert Trust Administration
Our firm expertly handles trust administration. A new client was facing serious tax consequences resulting from a trust that was not properly administrated at the death of her husband fifteen years prior. Our firm successfully rolled back the clock and created multiple trust documents to split the trust and take advantage of dual federal estate tax exemptions thus legally avoiding unnecessary and substantial taxes.
Expedite the Probate Process
At the death of a Great Grandmother, our clients found that the family estate included real property that had not been properly transferred. Our firm was able to step in and unravel the extensive nested probate situations in a timely manner, and deliver the inheritance to our clients.
Ethical, Cost Effective Representation
Anyone who is physically or mentally ill can be susceptible to improper influence. Caregivers may not benefit from changes in wills made by dependent elderly in their final days. Our client found themselves in this very situation when their parent’s at home caregiver suddenly became the full beneficiary of said estate. Our firm was able to freeze the assets and recover most of the estate for the original beneficiary, our client.
Estate Planning Strategies
When your assets exceed $11.4 million advanced estate strategies are required to limit taxation. Our firm provided an estate plan consisting of QTIPS, QPRTS, ILIT, and LLCs with fractional real estate interest providing valuation discounts. This strategy saved our client, a Newport Beach physician, hundreds of thousands of dollars in taxes.
Business Law Strategies
A corporate client looking to secure the financial health of the partners, follows our guidance and purchases “key man” insurance. When one of the partners is killed in a tragic accident, his spouse is provided financial liquidity and a transition plan goes into effect for the transition of an incoming partner.
A son, grieving the loss of his mother, finds that his stepfather has no intention of distributing his mother’s portion of the estate to her only child. Our firm negotiated a favorable settlement for the son, our client, while avoiding costly litigation.
A recent widower, married for 50 years, tookout a $400,000 reverse mortgage on his home and took a cruise where he was targeted by an unscrupulous companion half his age. One year later, his new companion siphoned away his assets and he passed away with an estate that had been reduced to almost zero. Our firm was able to recover the majority of his assets and distribute them to his niece, the rightful beneficiary, without the cost of litigation.
